Incapacity Benefit

Incapacity Benefit is paid if Statutory Sick Pay (SSP) is not applicable. Payment is based on National Insurance contributions.

It is not paid to anyone over the age of 60/65, although there are special circumstances if you are over 60 when you have to terminate your employment due to your illness.

Incapacity benefit is paid at three different levels depending on how long you are unable to work:

Short term lower rate – for the first 28 weeks

Short term higher rate – from week 29 to week 52

Long term – after 52 weeks
